DEFINITION

  • “You”/”Client” means the Person/Persons in whose name or on whose behalf the booking is made.
  • “We”/”Us”/ means Balmer Lawrie & Co. Ltd SBU: Travel & Vacations (Vacations Exotica)
  • “Independent Contractors” means hotelier/hotel owner, owner of any airlines or shipping company or Railway, Ferryboat owner/Operator, Coach owner/Operator, or any other person or organization who has been selected by us to render services to the Client.
  • “Tour Cost” means the amount mentioned in the Total Tour Cost column in the Booking Form overleaf.
  • All errors and omissions exempted.
    Note: All trade names and marks belong to the respective owners and we stake no claim or patronage of the same.
All information given in this brochure is based on the information available at the time of publication. We reserve the right to change any brochure information before or after your booking the Tour due to any events beyond our control. In case we are aware of any changes sufficiently in advance, we will notify you at the time of booking, otherwise our Tour Manager or Local Representative will inform you of the change. For instance major road works may necessitate route changes in the itineraries, Hotel/Restaurants may close or change management, all of these may cause us to make changes in the itineraries. Where we know of these sufficiently in advance we will notify you, otherwise our Tour Manager or Local Representative will inform you of the changes on the spot. There are also very big Trade Fairs, Exhibitions, Sporting Events, National Holidays, etc. where all the hotels are fully booked well in advance, and therefore it may be necessary to stay in hotels in other nearby cities.
The menus are preset menus provided for meals on the tour. The type of meals are clearly indicated in the brochure. Unlike an airline, we cannot process a special meal, nor do we guarantee a special diet to the Client, except to the extent mentioned in the brochure and preferred by you. We however reserve the right to change the meal arrangement if circumstances make it necessary to do so. In the event that the Client wakes up late and misses the breakfast offered to him or the Client is out on his own and reaches late and misses any meal offered to him, then no claim can be made for the meal, which he has missed and not utilized. Where special requests for room allocation, diet consideration on tour/cruise, etc. are made in writing at the time of booking, every effort will be made to ensure that they are honoured. However, we will not be held liable for claims or damages or consequential loss if such requests are not honoured / capable of being honoured. In case of single client joining the tour and wants to share the room we will only facilitate in the process and we will not be responsible in anyway for problem arising out of any such sharing during the course of the tour.

HOTELS
You will be out sightseeing most of the time and hence we have taken care to select hotels which are comfortable. Most of the rooms have private bath or shower. The hotels will either be those shown in the itinerary or of the same category. In Europe, since the rooms are comparatively small, we would recommend only 3 persons in one room for your own comfort. Triple rooms are usually no larger than Twin rooms an the third bed is often a rollaway cot put in a Twin room for a night. All baggage and personal effects are at all times and under all circumstances your responsibility. We will not be responsible or liable in case of loss of such items from the hotel. Any damages caused to the hotel rooms during your stay, shall be payable by you, and we will not be liable for the same.
COACH
We use air-conditioned/air-cooled luxury coaches. We have found it fair to operate daily seat rotation on coach, so no seat numbers are allocated. Some of the coaches are equipped with an emergency washroom, however this facility is not to be used in lieu of the restrooms at our frequent comfort stops. If you are carrying any high value items on the coach, we advise you not to leave them behind when you leave the coach. We will not be responsible or liable in case of loss of such items from the coach. All baggage and personal effects are at all times and in all circumstances your responsibility. Any damages caused by you to the coach during your travel shall be payable by you and we will not be liable for the same. The drivers are bound by specific rules, like maximum driving hours within a day and during a week, rest period per day/week, etc. Clients will have to strictly adhere to the prescribed timetable for the day so that the driver can complete the travel, otherwise certain sightseeing schedules may be missed due to your actions and the same will be non-refundable.
12 YEARS OF AGE
It is expressed and given to understand that a child below 12 years of age who is booked on the tour paying the special rate without a bed will not be provided with a bed in the hotel while on the tour under any circumstances. Incase the Client makes any changes in their rooming while on tour, we shall not make any refunds or pay any compensation. Incase the Client decides to make any change in the rooming while on the tour subject to availability, then you shall be bound to pay additional charge.
CANCELLATION DUE TO VISA REJECTION
All the Clients traveling on a Vacations Exotica Holiday tour must be in possession of a valid visa. However kindly note that it is entirely at the discretion of the concerned Consulate / Authorities to grant / reject visa even after submitting all relevant documents and we will not be held responsible for the same. We will not be responsible for non-issuance of visa due to receipt of incomplete / delayed documents from the Clients. It is a possibility that the consulate may ask the passengers to appear for a personal interview. This is at the sole discretion of the Consulate /Authorities. Any expenses for such personal appearance has to be borne by the client. Passengers whose visas are not granted by the consulates will be refunded as per the cancellation policy mentioned below. Any visa rejection, if it happens after the cut-off period of the tour the relevant cancellation charges will apply as per cancellation policy of the tour as set out here under. The date requested by the Client will be confirmed after the client obtains the visa and is subject to the availability of the tour at that point of time.
In cases where the travel agent through whom the clients have booked the tour signs the Booking Form for and on behalf of the persons named in the Booking Form, it shall be deemed and construed that the clients have duly authorized the said travel agent to sign on their behalf. The signing of the Booking Form by the Client or by their travel agent shall mean acceptance in totality of the Terms and Conditions contained herein by the Client/s. No person including Employee/s and our Agent/s, has the authority to vary, add, amplify or waive any stipulation, representation, term or condition set forth in this Brochure. Any assurance given by any person shall have no consequence. We reserve the right to decline to register any person/s as Client/s for any Tour or to cancel their registration without assigning any reason.
A transfer from one Tour to another, prior to the departure of the originally booked tour will be treated as a cancellation on that tour, thereby attracting the cancellation charges as stated hereunder and necessitating fresh booking charges on another.
All services such as Airline seats / Hotel accommodation / ground transportation for group tours are pre-blocked and pre-paid well in advance. We are liable to pay penalties to all our suppliers / vendors if these services are released within the below mentioned time frame. If circumstances make you cancel the Tour, the cancellation must be intimated to us in writing. Such Cancellation will attract the following cancellation charges:

We reserve the right to cancel any Tour prior to the departure, without assigning any reason. All monies paid by you will be fully refunded forthwith in Indian Rupees only, and no compensation will be payable. We cannot assume responsibility for any additional cost or any fees relating to the issuance and/or cancellation of air tickets or other arrangements not done through us.
All payments have to be made in favour of Balmer Lawrie & Co. Ltd. only, this is applicable even in case of bookings routed through Preferred Partner Agents / Travel Agents and the receipt of the payment has to be duly collected or asked for.
  • The balance payment towards the tour cost must be paid in the INR + Foreign Currency and should be made at least 45 days prior to date of departure
  • On receiving the total tour cost from you, we will issue your air tickets and your final tour documents.
  • In case the above condition is not fulfilled, there will be a delay in issuing your air ticket and subsequently arranging your visas.
  • In case there is any difference in airfare due to this, the same will be borne by the passenger.
  • In case we do not receive the total tour cost at least 45 days before departure, your booking deposit may be forfeited and your booking will stand automatically cancelled.
  • If any payment is made 10 days prior to the departure date, the same will have to be paid in cash / bank draft.
  • S.139A(5)(c) read with Rule 114B(k) of Income-tax Rules, 1962 which deals with “payment in cash in connection with travel” to any foreign country includes payment towards fare, or to a travel agent or a tour operator for purchase of foreign currency of an amount exceeding Rs.25,000 at any one time requires mandatorily to quote PAN in all documents pertaining to the specified transactions and casts a duty on the person raising bills against transaction to verify the validity of the PAN quoted. However, under Rule 114C(1)(a), following persons need not provide PAN:
    i) Person having only agricultural income;
    ii) Non-residents
    iii) Central / State Governments and Consular offices where they are payers.
    For persons as in (i) above, a declaration in Form 61 in respect of the transaction needs to be obtained by BL and the same needs to be twice in a year with the concerned CIT (CIB).
  • In case the Foreign Currency component is paid in cash a transaction fee of 0.50 paise per foreign currency unit will be applicable.
Refunds (If any) for amendments and / or cancellations will be paid directly to you for bookings made directly with our office. For bookings routed through our Preferred Partner Agents (PPA) or your Travel Agent, the refunds will be routed through them. It would take at least 30 days to process refunds. There is no refunds payable for any unutilized services (e.g. Meals, Entrance Fees, Optional Tour, Hotel, Sightseeing etc.) The refund for the Foreign Exchange component of the tour will be refunded in INR only and will be at the prevailing day’s rate of exchange of the dealer as per the prevailing Rules and Regulations. All refunds will be by account payee cheques only.
Cost of deviation - In case you wish to deviate from the group departure dates mentioned in the brochure i.e. either travel before the departure date of your tour or would like to come back on a later date after the tour ends, there will be an additional charge that will be applicable which will be advised to you by our sales team / partner agent. The same shall be allowed subject to availability of seats for the given dates & ticket validity. Kindly also note, the deviation request is to be made at the time of booking or at least 30 days prior to departure date. The deviation request will be subject to availability and payment for the same does not guarantee the date requested. In case the dates requested by you are not available, we will allot alternate dates accordingly, subject to seat availability.
We suggest you take your holiday spending money partly in currency, partly in Travellers cheques. Travellers cheques are a safe way to carry money as they are easily encashed for a small service fee and can be replaced if they are stolen or lost, provided you have the lost travelers cheque numbers and the counterfoil.
We are travel and holiday organizers only. We do not control or operate any airline, neither do we own or control any shipping company, coach or coach company, hotel, transport or any other facility or service mentioned in this brochure. We take care in selecting all the essentials/fundamentals in your holiday; but because we only select and inspect them and have no control in running of them, we cannot be responsible for any injury, death, loss or damage, which is caused by the act or default of the management or employees of any hoteliers, airlines, shipping company, coach owner /coach operator who are our independent contractors arising outside our normal control and inspection process.
We treat all the information furnished by you as confidential and will share only the necessary information with airline, hotels and other service providers who will provide the services to you during the tour. However we may be constrained to disclose the information furnished by you, if such disclosure is required by a law or by an order of a court or the rules, regulations or enquiry by any government / statutory agency having regulatory authority over us.
These conditions are applicable to every Client, who books a Brochure tour or any other Special Tour or travel arrangement. In the event of a Client booking through us a Tour or Tour Arrangement of any other Tour Operators like Carnival, Star Cruises, Cosmos, etc., the Terms and Conditions specified by such Tour Operator, including their payment schedule, cancellation, refund, etc. shall be applicable, in addition to our Terms and Conditions while determining the contractual relation/obligation between the Client, the Tour Operator and us.
It shall be the Duty of the Client to inform us / insurance company in case the Client has any medical condition that may affect his ability to enjoy and pursue fully the Tour Arrangements and wherein the interest of the Group or any member thereof might get prejudicially affected. Clients are requested to a make a note that any pre-existing ailment / disease is not covered for insurance purpose / claim incase of any illness during the course of the tour. We reserve the right to ask the Client to provide written certification of his medical fitness before departure. In the event that a medical condition has not been disclosed, we will not be liable to provide any assistance or money back. It is very Important to note that we are just a facilitator of providing travel insurance for the duration of the tour. Clients are requested to read thoroughly the terms & conditions. Incase of any claims/refunds the insurance company will be the final authority and we will in no way be held responsible in case of any dispute.
The communication directed at the address of the Client as disclosed in the Booking Form shall be deemed to have been communicated to the Client. A Travel Agent through whom a Client books will act to relay information from Client to us and vice versa. We shall not be responsible for any error on part of such Travel Agent in this regard.
  • The Client will have to strictly follow the Tour Programme and return to India as per the validity of the air ticket/visa. There shall be no refund, if the Client fails to join the group at the commencement of the tour, or joins the group later or leaves the group before culmination of the Tour. It shall be noted that for all purposes, it shall be the responsibility of the Client to reach the place of commencement of the Tour and register with our representative at the appointed place, date and time.
  • In case a Client along with his family is compelled to discontinue the tour due to any reason whatsoever not attributable to us including illness, death or loss of passport or any other travel documents, no claim shall be entertained for refund of unutilized services.
  • Even if a Client is unable to reach a place of commencement of tour due to any reason whatsoever not attributable to us including loss of baggage or loss of travel documents, his booking shall be treated as “No Show” on the tour and 100% cancellation charges will be levied.
  • If a client avails pre-tour services or part thereof, or the air tickets (cost of which is included in the main tour cost) but fails to join the group for the main tour at the appointed place, or cancels the tour after using the air tickets or pre-tour arrangements or part thereof, it shall be treated as “No Show” and there will be no refund whatsoever for the unutilized pre-tour or main tour services.
  • We, reserve the right to withdraw tour facility from anyone whose behaviour is deemed likely to affect the smooth operation of the tour or adversely affect the enjoyment or safety of other passengers and we, shall be under no liability to any such person. It is hereby declared that the immunities provided under this contract shall also be available to our Managers, including Tour Managers, Employees, Servants, Agents and Independent Contractors selected by us.
  • Each of these conditions shall be severable from the other and if any provision be invalid, illegal or unenforceable, the remaining provisions shall nevertheless have full force and effect. No liability on our part arising in any way out of the Contract in respect of any tour, holiday, excursion facilities shall exceed the total amount paid or agreed to be paid for the tour holiday, and shall in no case include any consequential loss or additional expense whatsoever.
  • It is a condition of the Booking that you take out a Holiday Insurance.
  • The prices quoted in this Brochure have been calculated at the rate prevailing at the time of printing of this brochure. We reserve the right to amend the prices published in this Brochure in case of currency fluctuations, changes in the various gross rates of exchange, and / or fuel costs, special / high season charge levied by the supplier, hike in the airline / rail charges before the date of departure and to surcharge accordingly. All such increases in price must be paid for in full before the Departure by the Client.
  • In case of any suit / action brought against us should be within the stipulated time as per the Consumer Protection Act, 1986, in case it is not done we shall be discharged from all liabilities under / or arising out of this contract and the Client shall be deemed to have relinquished / abandoned all his rights under or arising from this Contract.
  • If you book with a Travel Agent and your booking with that agent includes, but is not limited to our arrangements, your Contract is with your travel agent and we are simply a supplier to your travel agent.
  • In case of publication of any travel scheme offering any discount or benefit by us, we shall have the sole right to withdraw such a scheme or discount at any time unless a specific assurance on the contrary is published.
  • Joining direct clients (JD) will have to reach the hotel on their own at the specified time on day 1 of the tour and will have to reach airport on their own on completion of the tour.
  • In case of change in flight timing/s we reserve the right to change the tour routing. If the airline changes the schedule after printing of the brochure any increase/decrease in price including surcharges and taxes shall be applicable to the client.
  • We shall in no circumstances whatsoever be liable to the client for:
  • Any over stay expenses due to delay or changes in bus / air / trains / ship or cancellation of special bogie or other services due to sickness, weather conditions, strike, war, terrorism or any other cause whatsoever which are beyond our control.
  • Sightseeing missed and/or program being cancelled after the commencement of the tour and before the due period due to any unavoidable situations which are beyond our control.
  • In the case of one or more but not all passengers signing ‘Booking Form’ it shall be deemed that others have duly authorized concerned signing passenger / (s).
  • Initial deposit just ensures seat or participation on the tour but does not entitle any services like Tickets, Visas and Hotel Accommodation until full payment has been received.
  • Full payment must be in accordance with the procedure in the brochure, in-case of non-payment we, reserve the right to cancel booking with subsequent loss of deposit & apply cancellation charges as mentioned therein.
  • We are repentant that we cannot endow with individual aid to any of th e tour member for walking, dining, getting on & off from any of the transport vehicle or other personal needs. So it is indispensable that a qualified companion must accompany the traveler who needs such assistance.
  • Validity of the passport: Traveler must have his valid passport for at least 6 months subsequent to such departure.
  • We solely reserve the right to publish group photographs of the passengers taken during the tour.
  • Distance, temperature & pre / post tour accommodation prices given in the Brochure are approximate & are subject to change.
  • Photo of meals and sightseeing published in the Brochure are only for reference and may change from actual meals served / sights. In case company offers any adventure activities then it is significant to note that all the passengers should enjoy such activities / ride at their own risk, as such kind of adventure might be risky at times especially for heart patients, expecting women, people with blood pressure, etc.
  • There is no Contract between us and the client until we have received the initial deposit plus visa charge. The full payment must be received in accordance with the Booking Form. If not paid in that time, we reserve the right to cancel the booking with consequent loss of deposit and apply the cancellation charges as mentioned here-in before.
  • We have the right at anytime and for any reason
  • To terminate this contract after acceptance of deposit but prior to the commencement of the tour without assigning any reason whatsoever. In the event, we terminate this contract and we shall refund the amount paid by the client without payment of any interest.
  • To amend, alter, vary or withdraw any tour, holiday, excursion airline, flight routing or facility it has advertised or published or to substitute an independent contractor of similar class if it deemed advisable or necessary. In either case, we shall not be liable for damage, additional expense, or consequential loss suffered by the clients or for any compensation claims made.
  • No person other than us, in writing, has the authority to vary, add, amplify or waive any stipulation, representation, term or condition in the brochure.
  • In the event of our exercising our rights to amend or alter any of the services as mentioned in the itinerary, after such tour or holiday has been booked, the client shall have the right:
    a. To continue with the tour or holiday as amended or altered
    OR
    b. To accept any alternative tour or holiday which we may offer. In either of these above cases, the client shall not be entitled to, or we shall not be liable to the client for any damage, additional expense, consequential loss suffered by him or to pay any amount as refund.
  • We shall in no circumstances whatsoever be liable to the client for:
    a. Any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and / or damage or any misadventure howsoever caused.
    a) If the Client has any complaint in respect of the services provided by any of the Independent Contractors, the client shall immediately notify the same in writing to the Independent Contractor and a copy thereof should be handed over to the Tour Manager in order to enable us to take up the matter with the Independent Contractor.
    b) Any claim or complaint by the client must be notified to us in writing within 7 days of the end of this holiday tour. No claim notified to this company beyond this period will be entertained.
  • It is mandatory that you purchase the Overseas Travel Insurance policy from the Insurance Company identified and named by us.
  • The client/s hereby agrees and undertakes that the traveler has/have/will purchase the foreign exchange from Authorised person only and within the prescribed limits in accordance with the Rules, Regulation and Directions in force.
  • The tour is subject to RBI / GOI rules and regulations. Part of the tour cost will be paid in Foreign Currency as per the tour decided out of your BTQ (Basic Travel Quota)/ Consolidated remittance facilities under Current Account Regulations & the Liberalised Remittance Scheme (LRS) As per RBI regulations under the Consolidated remittance facilities under Current Account Regulations & the Liberalised Remittance Scheme (LRS), all resident individuals, including minors are allowed to freely remit up to USD 2,50,000 per financial year (April-March) for any permissible current account or capital account transaction or a combination of both. This limit can be used for undertaking one or more private / personal visits to any country abroad ( Except Nepal & Bhutan) in any financial year.
  • Declaration under Liberalised Remittance Scheme (LRS) / Other Statute.
    I, (Name), hereby declare that the total amount of foreign exchange purchased from or remitted through, all sources in India during the financial year 20___ – ___ is within the overall limit of USD 2,50,000/- (US Dollar Two lakh Fifty Thousand only), which is the limit prescribed by the Reserve Bank of India for the purpose and certify that the source of funds for making the said remittance belongs to me and the foreign exchange will not be used for prohibited purposes. It is hereby agreed that all disputes arising concerning the validity, construction or effect of the agreement or rights and obligations created there under, shall be mutually discussed and settled amicably. This agreement shall be governed by Indian Law and be subject to the exclusive jurisdiction of the Courts at Kolkata.
  • I (Name), hereby authorize M/s Balmer Lawrie & Co. Ltd. to collect the required amount towards all my travel/holiday needs on my behalf and remit the same to the service providers/operators/distributors.
  • Offered discounts cannot be clubbed or used with any other ongoing discounts, vouchers, offers and promotions.
